Terms of Service for Testing

These Terms of Service for Testing ("Testing Terms") govern your use of the Verifa identity verification platform ("Service") on the Free plan, operated by Verifa ("we," "us," or "our"). By creating a free account, you agree to these Testing Terms.

1. Service Description

The Free plan provides access to Verifa's identity verification platform with 100 live verifications per month and unlimited sandbox access for evaluation, testing, and integration. The Free plan is valid for 6 months from account creation. Sandbox mode uses simulated verification results; live mode processes real identity documents against production verification systems.

The Free plan is provided to help you:

• Evaluate whether Verifa meets your identity verification needs
• Build and test API integrations in sandbox before going live
• Process a limited number of real identity verifications
• Configure workflows, webhooks, and dashboard settings
• Train your team on the platform

2. Free Plan Limitations

The Free plan is subject to the following limitations:

• Live verification limit: 100 live identity verifications per calendar month. Your quota resets on the 1st of each month.
• Free plan duration: The Free plan expires 6 months after account creation. After expiration, you must upgrade to a paid plan to continue using live verifications. Sandbox access remains available.
• Sandbox data: sandbox sessions produce simulated results and are not suitable for real identity verification decisions. Sandbox data may be deleted at any time without notice.
• No uptime guarantee: we may perform maintenance, updates, or modifications to the platform at any time without notice
• Rate limits: API access is subject to rate limits that may be more restrictive than paid plans
• Feature availability: all features are unlocked in sandbox for evaluation; some advanced features (AML screening, liveness detection, watchlist monitoring) require a paid plan in live mode

3. Acceptable Use

You agree to use the sandbox environment only for legitimate evaluation and integration testing purposes. You may not:

• Use sandbox mode to process real identity verification requests or make real decisions about individuals
• Submit real government-issued identity documents or real personal information of individuals without their knowledge
• Attempt to bypass sandbox limitations, rate limits, or access controls
• Use the Service for any purpose that violates applicable law
• Reverse-engineer, decompile, or extract source code from the Service
• Share API keys or account credentials with unauthorized parties

4. No Warranty

The sandbox environment is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the sandbox environment will be uninterrupted, error-free, or secure, or that any defects will be corrected.

5. Limitation of Liability

To the maximum extent permitted by law:

• Verifa's total aggregate liability arising out of or relating to your use of the sandbox environment under these Testing Terms shall not exceed $500.00 USD.
• Verifa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill, regardless of the cause of action or theory of liability.
• These limitations apply even if Verifa has been advised of the possibility of such damages.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us promptly of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to secure your credentials.

7. Intellectual Property

The Service, including its software, algorithms, interface designs, API specifications, and documentation, is the intellectual property of Verifa. Your use of the sandbox environment does not grant you any ownership rights. You may reference Verifa's API documentation for integration purposes.

8. Privacy

Our handling of any data you provide is governed by our Privacy Policy. Even in sandbox mode, do not submit real personal information of third parties without a lawful basis. If you submit your own personal information for testing purposes, it will be handled in accordance with our Privacy Policy.

9. Upgrading to a Paid Plan

To increase your monthly verification limit and access advanced features, you can upgrade to a paid plan (Starter, Professional, or Enterprise). Upon upgrading, the full Terms of Service will apply and supersede these Testing Terms. Visit our Pricing page for plan details.

10. Termination

• You may stop using the sandbox and close your account at any time.
• We may suspend or terminate your sandbox access at any time, for any reason, with or without notice. Reasons include, but are not limited to: violation of these Testing Terms, abusive usage patterns, or inactivity.
• Upon termination, your access to the sandbox environment will cease and any data stored in your sandbox account may be deleted.

11. Dispute Resolution

Any dispute arising from or relating to these Testing Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Testing Terms at any time. Continued use of the sandbox environment after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These Testing Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
